Terms of Service

These Terms govern your access to and use of the itskode platform, including managed deployments, edge functions, domains, and affiliated services.

1. Who We Are & Contact

These Terms are offered by Itskode, operated by Farrukh Saleem (sole proprietor) with its principal place of business in Karachi, Sindh, Pakistan. All references to “we,” “us,” or “our” mean this legal business. Payments for our products are processed by Paddle.com Market Ltd. and Paddle.com Inc. acting as the Merchant of Record.

2. Account Eligibility & Responsibilities

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to create an account. When you register, you agree to provide accurate information, protect your credentials, and ensure that your use of the platform complies with all applicable laws and your organization's policies.

You are responsible for all activity under your account, including activity by teammates invited to your workspace. You must keep access tokens, SSH keys, and API credentials secure and notify us immediately if you detect unauthorized use.

3. Acceptable Use

You may not use the platform to host or distribute malicious code, phishing schemes, hate speech, or content that violates intellectual property rights or any applicable law. Reverse engineering or load-testing our infrastructure without prior written consent is prohibited.

We reserve the right to investigate abuse reports and suspend projects that threaten platform stability. You remain solely responsible for the content you deploy and any consequences resulting from it.

4. Deployments, Builds & Usage

Deployments draw down build minutes, storage, bandwidth, and logs according to your subscription tier. We may enforce fair-use limits to prevent excessive usage that degrades service for others. Edge and serverless functions are designed for bursty workloads; sustained compute should move to dedicated infrastructure.

You are responsible for managing backups of your data. While we maintain redundant storage, we cannot guarantee recovery of user content deleted by you or your team.

5. Domains & DNS

You may connect custom domains through DNS providers of your choice. You warrant that you own or control the domains you attach and that you will maintain up-to-date DNS settings. When we provide managed DNS, you authorize us to provision TLS certificates and perform necessary validation.

Domain registrations through us are subject to registrar-specific policies, including renewal windows and redemption fees.

6. Payments, Refunds & Paddle

Paddle acts as the Merchant of Record for all card and wallet transactions. Prices, taxes, and currency are displayed at checkout. By purchasing, you authorize Paddle to charge your selected payment method and to share transaction details with us to fulfill your subscription.

We honor Paddle's buyer protection: you may request a full refund for any charge (including renewals) within 14 days of the transaction date with no qualifiers or exceptions. Request a refund through your account billing settings, by contacting [email protected], or via Paddle buyer support at [email protected]. Refunds are issued to the original payment method and processed by Paddle.

7. Service Model (Human Involvement)

Itskode is a self-service software platform. We do not sell bespoke, human-delivered services or manual project work as part of the standard offering. Our human involvement is limited to customer support, account review, and fraud prevention; product delivery and value are provided through the software.

8. User Content & License

You retain ownership of all code, media, and content you deploy. By hosting content on the platform, you grant us a worldwide, non-exclusive license to store, cache, transmit, and display that content solely for the purpose of operating the platform. You represent that you have all rights necessary to grant this license.

9. Intellectual Property & Notices

itskode and its licensors own all intellectual property in the platform, including software, documentation, logos, and dashboards. If you believe content hosted on our platform infringes your rights, submit a written notice to our designated contact with sufficient detail to act on the claim (a DMCA-style process).

10. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance windows will be announced in advance when possible. We may implement emergency maintenance at any time to address security or stability issues. Credits for downtime, if any, are described in your plan's Service Level Agreement.

11. Third-Party Services

The platform integrates with third-party providers (Git hosts, analytics tools, payment processors). We are not responsible for outages, data loss, or pricing changes introduced by those providers. Your use of third-party services is governed by their respective terms, which you must review and accept separately.

12. Billing & Subscriptions

Paid plans are billed in advance on a subscription basis. Usage-based add-ons (e.g., bandwidth overages, additional builds, logs, or add-on services) are billed at the end of the billing cycle. Auto-renewals occur at the stated cadence unless you cancel before the renewal date. You authorize Paddle to charge your payment method on file.

If payment fails, we may suspend access until the outstanding balance is cleared. You may cancel at any time to stop future billing and you remain eligible for a full refund on any charge within 14 days of the transaction date consistent with Paddle's policy.

13. Suspension & Termination

Either party may terminate the agreement at any time by closing the account. We may suspend or terminate your access immediately if you violate these Terms, create a security risk, or fail to pay fees when due. Upon termination, your access ceases and we may delete your projects and data after a reasonable retention period.

14. Disclaimers & Limitation of Liability

The platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, special, incidental, or consequential damages, nor for lost profits or revenue.

15. Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. If your local law requires another jurisdiction, the law of your primary place of business will apply. Any dispute will be resolved in the courts located in Karachi, Pakistan, unless otherwise required.
